These Terms of Service ("Terms") govern your use of dispatchdeskhq.com and the services provided by DispatchDesk, a d/b/a of Twelve Point Ventures, LLC ("DispatchDesk," "we," "us," or "our"). By using this site or our services, you agree to these Terms.
1. Our services
DispatchDesk provides AI receptionist, call answering, missed-call text-back, appointment confirmation, lead notification, and review-request services on behalf of local home-service businesses, including HVAC, plumbing, electrical, flooring, and similar trades. Specific features, pricing, and service levels for a client are set out in that client's separate service agreement, which controls if it conflicts with these Terms.
2. Who these Terms apply to
- Business clients who purchase DispatchDesk services.
- Site visitors who browse dispatchdeskhq.com or submit a form.
- Callers and customers of a business that uses DispatchDesk, with respect to the calls and messages they exchange with that business.
3. Fees and billing
Setup fees and monthly subscription fees are stated in the client's service agreement or invoice. Unless stated otherwise, monthly fees are billed in advance and are non-refundable for the period already begun. Pass-through costs, such as domain registrations purchased on a client's behalf, are billed at cost. Rates quoted as founding or promotional rates apply only for the term stated in the client's agreement.
4. Term and cancellation
Service continues month to month until cancelled. Either party may cancel with written notice as provided in the client's service agreement. On cancellation, we will stop billing at the end of the paid period and will cooperate in returning or transferring the client's phone number and account settings where technically possible. Setup fees are not refundable.
5. Client responsibilities
- Provide accurate business information, pricing, hours, and service details, and keep them current.
- Obtain and maintain any consents required for the phone numbers you provide to us for messaging.
- Respond to leads and appointments passed to you. DispatchDesk answers and routes; the client performs the work.
- Use the service only for lawful business purposes and in compliance with applicable telemarketing, messaging, and consumer protection laws.
6. Acceptable use
You may not use the service to send unsolicited bulk messages, to send content that is unlawful, deceptive, harassing, or that promotes prohibited categories under carrier rules (including illegal substances, hate speech, or fraudulent offers), or to attempt to interfere with, reverse engineer, or gain unauthorized access to our systems. We may suspend service immediately for violations that create legal or carrier risk.
7. Text messaging
Messages are sent only to recipients who have opted in, as described in our Privacy Policy. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. Carriers are not liable for delayed or undelivered messages.
8. AI-assisted service
Our call and message handling uses automated and AI-assisted systems. While we work to keep responses accurate, automated systems can misunderstand, mis-transcribe, or misroute. Clients are responsible for reviewing lead and appointment details before relying on them, and for confirming pricing and commitments with their customers.
9. No guarantee of results
Examples, revenue math, and figures shown on this site are illustrations, not promises. We do not guarantee any specific number of calls answered, leads captured, appointments booked, reviews earned, or revenue produced.
10. Third-party services
The service depends on third-party providers, including telephony, messaging, hosting, scheduling, and payment platforms. Outages, changes, or restrictions imposed by those providers or by mobile carriers may affect service. We are not responsible for third-party failures outside our reasonable control.
11. Intellectual property
The DispatchDesk name, site content, designs, scripts, and configurations we create remain our property. Clients receive a non-exclusive right to use them for their own business while the service is active. Client business names, logos, and content remain the client's property, and the client grants us the right to use them as needed to deliver the service.
12. Confidentiality
Each party will protect the other's non-public business information and use it only to perform under these Terms.
13. Disclaimer of warranties
The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.
14. Limitation of liability
To the fullest extent permitted by law, DispatchDesk and Twelve Point Ventures, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost business opportunities. Our total liability for any claim arising out of or relating to the service will not exceed the amounts paid by the client to us in the three (3) months preceding the event giving rise to the claim.
15. Indemnification
Clients agree to indemnify and hold harmless DispatchDesk and Twelve Point Ventures, LLC from claims arising out of the client's business operations, the work the client performs for its customers, the content or accuracy of information the client supplies, and the client's failure to obtain required messaging consents.
16. Governing law
These Terms are governed by the laws of the State of Louisiana, without regard to conflict of law rules. Venue for any dispute lies in the state or federal courts located in Louisiana.
17. Changes to these Terms
We may update these Terms. The "Last updated" date above reflects the current version. Continued use of the site or service after an update constitutes acceptance.
